Santa Cruz short sales can have pitfalls with some lenders; Santa Cruz Reo's maybe safer

According to this recent article that I read as a Santa Cruz, California Realtor, some lenders are trying to get money they should not be getting. The essence of a loan sequence is this. The first is first in line when they need to collect the money, the second is second in line, and while there are not many in Santa Cruz real estate, the third is in last place.

As so many property values have plunged and or the loans that were made were foolish ones, the second loans are often being wiped out, meaning that lender get's nothing or virtually nothing. Can you imagine as a banker going to your boss and saying,"hey boss, I just lost you $200,000" how that would go? The reality is that many of these loans were not bad loans, but were loans that should have never been given in the first place. That being said, some of these lenders are so desperate that they are trying to recoup any of their money, even by illegal means. Read below what the California Association of Realtor's Association has to say on the matter.

So an agent participating in this exercise can be subject to many disciplines from state and federal sources.Think carefully if the risks are worth it.

Many short sale seconds really gum up the works as they still have some power.You the seller cannot sell your home without all the lienholders signing off for the transfer to occur. So they yield some small power to extract some money from the buyer or the first position lienholder.Sometimes the demands are so onerous,that a seller decides to choose bankruptcy. Before you embark on any course of action,Santa Cruz short sales or Santa Cruz REO's it is advisable to consult an attorney on these matters.

"UNDISCLOSED SHORT SALE PAYMENTS MAY BE ILLEGAL

Undisclosed payments in short sale transactions, especially those paid outside of escrow, may violate the law, including RESPA, laws against loan fraud, and licensing laws.  Short sale agents have increasingly reported to C.A.R. about requests for agents and their clients to pay junior lienholders and others, oftentimes outside of escrow.

One common scenario is when a short sale seller's senior lender authorizes a payment of $3,000, for example, to extinguish a junior lien, but the junior lender( often a second)demands that the buyer pays an additional $9,000 outside of escrow. 

Not only would it be risky for a buyer to pay outside of escrow, but concealing this additional payment from a federally-insured senior lender may constitute loan fraud, which is a crime punishable by 30 years imprisonment plus a $1 million fine. Furthermore, omitting from the HUD-1 Statement any charges paid at settlement by either a buyer or seller may violate the Real Estate Settlement Procedures Act.  

Depending on the specific circumstances, carrying out these payment requests may also violate other laws and regulations, and an agent's participation in the scheme may be subject to license revocation by the Department of Real Estate or other disciplinary action.

While we may all feel the banks pain for making so many bad loans,we are all supposed to play by the rules and some of these are clearly breaking them. Many Americans do not like to accept responsibility for their actions, such as taking a loan they could not afford, to lenders who took risks, got high interest loans, and lost their gamble. Remember banks used to be conservative; seems they all drank the cool-aid.

If something like this is going on,talk with your agent on how best to proceed. One wants to get the home you are under contract on, but putting yourself and agent in a position of doing something illegal may not be in your best interest.

Santa Cruz is pretty, the homes interesting, the college, UCSC, beautiful.......

Recently our local institution of higher learning UCSC has named by Forbes as on of the 10 prettiest campuses in the world. Now that does not surprise me as I have been telling Santa Cruz real estate clients that for years it is one of the prettiest they will find.UCSC made the international list that includes another local university,Stanford, in Palo Alto, Princeton in New Jersey and the Scripps in Claremont, Ca. You can check out the slide show of the others in other parts of the world, but I didn't want all the commercials.


UCSC homes vary quite a bit as some are condos for students, while others are parts of a subdivision known as University Terrace, in west Santa Cruz that are larger for campus workers or faculty. The housing market here is quite varied with a whole range of styles and locations to choose from, just like these campuses.

The fact that the University of Santa Cruz is chosen was not a surprise. If you have ever been to the campus, the drive alone will make most recruits decide for the affirmative. With stunning panoramic ocean views of Santa Cruz to Monterey bay area below you as you head up or down from campus, one can't help but admire the natural beauty. While UCSC is a heavy weight in many academic areas, the combination of mind and spirit and the natural beauty is really a great treasure to have. With paths through the towering redwood trees to, the path to education here is crowded with beauty. While Santa Cruz real estate is most valued by those of us who live here, the University of Santa Cruz occupies some of the most valuable real estate in Santa Cruz. The golden rolling hills at times dotted with cattle or even mountain bikers on the way to rides is almost surreal in it's beauty.

If you have a child considering a college near or far from home, this is a beautiful place to get a grounded education in a wide variety of subjects. Definitely do check out UCSC and if you decide to go, call me for help in locating a home to buy in Santa Cruz. Santa Cruz real estate- why we pay so much for a home-not all real estate is the same


I was talking with a colleague Russ about things in his neck of the woods regarding homes in Bucks County, Pennsylvania. The thing that impressed me was what people have to do to get to work when there is a snow storm.
 The faithful dog, out to find some yellow snow or a newspaper
for his master who no doubt had to shovel that walk way up to his home. Pets seems to do pretty well in snow, but when they come inside you need to have a place for them to thaw out and let the melting snow get soaked up.



This is generally called a tree, but when it has so much snow, I think of it as a snow sculpture.It sure is pretty, but as I sit with the Rio Del Mar beach just blocks away, I recall how beautiful both are and am glad I get to enjoy the crashing waves and sunny days without having to shovel my drive way and car out before I go to work. Maybe shots like this is why Santa Cruz real estate is so popular?
While we don't have to worry about snow in Santa Cruz, we both face winters of one sort or another.Santa Cruz real estate has a higher price in general because we don't face the severe winters that they face back on the east coast. So we discussed how a natural disaster such as a large snow storm puts a huge dent in the wallet of the city coffers. With real estate values fallen in most all states and most cities getting their revenue from taxes based on that value, almost all municipalities are having a rough time financially.
So while we all are trying to get back to some economic sense of stability, there are some great deals to be had, even by the beach in Rio Del Mar.Homes here are still more expensive, but what would you rather enjoy if you could during the winter, the scene up top or the one below? Santa Cruz Beer Fest participants eagerly serving up great beer- walk from your Santa Cruz home to one of these events

As you might imagine many people know Santa Cruz has it's own wine appellation and you might even know someone who make Santa Cruz wine. The fact is we have quite a few wineries in the area from Bonny Doon to Corralitos with many in between. There are also a few breweries,which are not as well known in different parts of Santa Cruz.

Santa Cruz is once again participating in the SF Beer Week, which is encompasses a wide range of places. It got started in SF, but is really a regional beer festival with brewmasters and breweries from throughout the region from Santa Rosa to Santa Cruz. So if you are a Santa Cruz real estate owner or renter near one of these places, the opportunity to walk to a nice beer tasting event is a smart one if you can. Look on the map to find the pub nearest you.



A local brewery in the Santa Cruz area is Seabright Brewery, located in the Seabright area of east Santa Cruz. On the West side of Santa Cruz there the Parrish Publick House in the Safeway shopping center off of Almar, and the Santa Cruz Mountain Brewing nearby in the Kellys Bakery complex on Ingalls street. Downtown there is 515 Kitchen and Cocktails( 515 Cedar street) that has a number of food/ beer pairing events too as well as one of my favorite local restaurants on Pacific, Vida.

Veterans Day ideas in Santa Cruz, Ca... musings on the idea of a veteran

What is a Veteran?

Today is a day of remembrance for many. For many school kids it is just another day off. A day to play and have fun. No worries, no getting up early, nothing that relates to the meaning of the day. On the surface many of us are used to the word veteran. There is veteran news man, veteran football player, or even veteran Realtor. We like veterans, as that says to most of us, experienced. We paid our dues, we want experience. Most of us know from first hand knowledge the value of youth, but also know the cost and value of experience. As we get older we realize youth has it's value, as rookies, we realize they make more mistakes that a veteran won't make. That can be from working on our car and mis-diagnosing something, to cutting the wrong way on a pass play on a football field. We realize that with experience a veteran, may cost more, but are more valuable. As a veteran Realtor, many value me because I generally don't make the mistakes the rookies make. I think the term service and dedication are other terms we associate with term. These are all good honorable qualities.

Here is the dictionary definition of what a veteran is:

So today is really a dedication to the rookies mostly, some of whom we know that survived, and others who have fallen in service to our country. Those veterans have had at times inglorious and harrowing experiences. Sometimes the country despised them, and at other times revered them. A Veteran's Day in Santa Cruz is one I am sure that has deep and divisive meanings to both sides. There is youth and idealism that  is kin to UCSC and then there are those that served in our armed forces in war times and others in times of peace. The brave soldiers, men and women do so that people may have the ability to voice their dissent on ideas. Just don't question the bravery and sacrifice that our veterans have provided so one can have a dissenting opinion of war or other things. They did not start the war, but were and are there to defend your and my right to free speech.

So do we celebrate or separate our patriotism for those who's life was on the line from those who served in times of peace? The World War II Veterans that likely saved the world from some maniacal dictators were and are held in high esteem and have always been so. Theirs was a noble and selfless cause of service. Regular Joes and movie stars alike served in this effort. While Vietnam Veterans who were also drafted were generally despised for their service. I  think this was really our despise of our government's policies on war, that we despised the poor young soldiers, rookies, were made the butt of that. Unfortunately, they were doing a bidding of their president in an unpopular and pointless war. Much the same as our fine young men and women went to war for our president in Iraq and further in Afghanistan and other regions in the world. Hopefully those will have some meaning in the larger context of world history from the enslavement of religion and stateless sponsors of terror.

We solicit our youth to our volunteer military with incentives such as money for education, and other benefits. Many other country's require military service, we don't.Our youth that enlist do so willingly. Sometimes due to economic times,it seems like the best of the worst choices. We know that the young are the most likely to join as they have no experience in the general work force and are often good candidates for the military. So those that join and serve in either active duty or support get my respect. They have at times given the ultimate sacrifice, and at others been savaged by the horrific weaponry or disease from war. Nowadays not as many are dying, but in even greater numbers they are suffering from traumatic brain injuries and loss of limbs in heretofore unseen numbers.

So for all those before and those now serving my hat is off to you and I greatly admire your courage to face things not faced by us civilians. Thank you.

Octoberfest in Rio Del Mar- Seabreez Tavern; Aptos Octoberfest Event at the beach

Rio Del Mar is a special place to many. For some, coming to the bar and restaurant the on the shoreline has been a family tradition. The Seabreeze Bar has been there in Rio Del Mar since it's inception. Rio Del Mar was designed to lure folks from the inland areas to our beautiful beach.

Now you can go to the Sea Breeze Tavern and the local Cafe Rio to enjoy of day of Octoberfest in Aptos.The event will feature 10 beers, food and other fun times.Some of the beer will be German, and others America.

There will also be seven local home brewers at the event. As a participant of the event you will get to judge the best home brew. Tickets are $15 before the day of the event and $20 the day of the BrewFest. This includes an engraved glass and one pint of the featured brews and a taste of each one of the home brews, mm yummy. There are a limited number of engraved glasses - so get your tickets early. The event will be between 12-6 Pm at 101 and 131 Esplanade, at Rio Del Mar Beach, Aptos, Ca,  Be sure to pick up your fudging form for selecting the best home brew!

Santa Cruz Real Estate local features- Search for Santa Cruz homes and see local schools and shops nearby

I have a new feature that is really cool. When you are a registered client on my site Cacoastalhome, and are searching for Santa Cruz real estate listings, you can find the local information that may be of interest.

For instance some clients of mine are wanting a Rio Del Mar beach house that is located closer to shop and restaurants. With this feature they can see their potential home, and the nearby restaurants, grocery store that may be of interest to them.
